In these terms, “we”, “us”, and “our” mean Studio Janne Wellens. “You” and “your” mean the customer.
1. Applicability
These Terms of Service apply to all products and orders placed through our webshop.
By placing an order, you agree to these terms. These terms do not limit any mandatory consumer rights under Dutch or European law.
2. Products and product information
We describe our products as accurately as reasonably possible, including their dimensions, materials, colours, availability, and condition.
Small differences in colour, texture, finish, or appearance may occur, particularly where products are handmade, artistic, or made using natural materials. Such differences are not defects unless the product materially differs from its description.
If a product is made to your specifications or personalised, this will be stated on the product page or confirmed separately.
3. Prices and payment
All prices are stated in [EUR] and include VAT where applicable, unless clearly stated otherwise.
Shipping costs are shown separately at checkout. For large or special items requiring individual transport arrangements, the shipping cost may be quoted separately before the order is confirmed.
We accept the payment methods displayed at checkout. Payment must be completed before we dispatch the product, unless we have agreed otherwise in writing.
We may correct obvious pricing or availability errors. If an order was placed at an obviously incorrect price, we will contact you and give you the option to confirm the order at the correct price or cancel it for a full refund.
4. How the contract is formed
Your order is an offer to purchase a product.
After placing an order, you will receive an order confirmation by email. The contract is formed when we accept your order and confirm it, subject to product availability and payment.
If we cannot fulfil your order, we will inform you and refund any payment made for that order.
5. Shipping and delivery
We deliver to the countries shown at checkout.
Available delivery methods, costs, and estimated delivery times are displayed before you complete your purchase.
Estimated delivery times are:
Netherlands: 2-4 business days
Other EU countries: 2-4 business days
Large or special items: confirmed individually
Delivery times are estimates unless a specific delivery date has been agreed.
For large, fragile, or special items, we may contact you after purchase to agree a suitable delivery method and price. Where an individual transport quote is required, the order is not finally confirmed until you have accepted that quote.
We are responsible for the product until it is delivered to you or to a person designated by you, unless the law provides otherwise.
If a product arrives damaged, please contact us promptly at info@jannewellens.com and provide photographs of the packaging and product. This does not affect your statutory rights.
6. Store pickup
Where Store Pickup is offered at checkout:
Pickup is available at Staringplein 13, 1054 VJ Amsterdam, unless another location is stated.
Pickup is free.
Available collection times and instructions will be provided in the order confirmation or collection email.
You must bring your order confirmation when collecting the order.
If you cannot collect your order within [insert number] days, contact us to arrange an alternative date.
Online purchases collected in person remain subject to applicable statutory consumer rights.
7. Right of withdrawal
If you are a consumer, you generally have the right to cancel an online purchase within 14 days without giving a reason. The period normally begins on the day you, or a person you nominate, receives the product. europa.eu
To exercise this right, email info@jannewellens.com within the withdrawal period. You may use the model withdrawal wording at the end of these terms.

You are responsible for the direct cost of returning the product unless:
The product is faulty;
We sent the wrong product; or
We agreed to pay the return cost.
For large or bulky products, we will provide an estimate of the return cost where required.
Products must be returned with reasonable care. You may handle a product only as much as necessary to inspect it as you would in a shop. You may be responsible for any reduction in value caused by unnecessary handling.
We will refund the purchase price and the cheapest standard delivery cost. We may wait to refund until we receive the product or receive proof that you have returned it.
8. Exceptions to withdrawal
The right of withdrawal may not apply to:
Products made to your specifications or clearly personalised;
Products that deteriorate or expire quickly;
Sealed products unsuitable for return for health or hygiene reasons once unsealed;
Sealed audio, video, or software products once unsealed;
Digital content supplied immediately after purchase where you expressly agreed to immediate delivery and acknowledged losing the withdrawal right; or
Other statutory exceptions that apply to the relevant product.
A product is not automatically excluded from withdrawal merely because it is large, expensive, fragile, or difficult to transport.
9. Faulty or non-conforming products
Products must conform to the contract, their description, and the qualities you could reasonably expect.
If a product is faulty or does not conform, contact us at info@jannewellens.com with your order number and a description of the issue.
Depending on the circumstances, we may offer repair, replacement, a price reduction, or a refund. We will handle valid conformity claims without charge to you, including reasonable return costs.
EU law provides a minimum two-year legal guarantee for goods, while Dutch law may provide protection beyond two years depending on the product’s expected lifetime. europa.eu
10. Cancellation before dispatch
You may contact us to request cancellation before dispatch. We will try to accommodate the request, but cancellation is not guaranteed once the product has been dispatched or custom production has begun.
This does not affect your statutory right of withdrawal.
11. Intellectual property
Unless otherwise stated, all photographs, product images, drawings, text, designs, logos, and other content on this website belong to Studio Janne Wellens or are used with permission.
You may not copy, reproduce, modify, distribute, or commercially use this content without our prior written permission.
Unless expressly agreed in writing, purchasing a physical product does not transfer copyright or other intellectual-property rights in its design, artwork, images, or underlying concept.
12. Personal data
We process personal data in accordance with our Privacy Policy.
We use customer information to process orders, take payment, arrange delivery or pickup, provide customer service, comply with legal obligations, and send marketing communications where legally permitted and where you have provided the required consent.

13. Complaints
If you have a complaint, contact:
Please include your name, order number, and a clear description of the complaint.
We aim to respond within 14 days. If a complaint requires more time, we will tell you when you can expect a substantive response.
14. Liability
We are liable only as permitted under applicable law. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for intentional misconduct, gross negligence, defective products, or mandatory consumer rights.
15. Changes to these terms
We may update these terms from time to time. The version applicable to your order is the version published when you placed that order.
16. Applicable law
These terms are governed by Dutch law.
If you are a consumer resident in another EU country, this choice of law does not remove protections that cannot legally be excluded under the mandatory law of your country of residence.
